제1조 (목적)
이 약관은 주식회사 소프트마인(이하 "회사")이 운영하는 웹사이트 및 제공하는 모든 서비스(이하 "서비스")의 이용 조건 및 절차, 회사와 이용자의 권리·의무 및 책임사항, 기타 필요한 사항을 규정함을 목적으로 합니다.
제2조 (용어의 정의)
이 약관에서 사용하는 용어의 정의는 다음과 같습니다.
- "서비스"란 회사가 웹사이트를 통해 제공하는 SI 구축, SM 운영, AI 컨설팅, 데이터 거버넌스, 디지털 전환(DX) 관련 정보 제공 및 문의·상담 서비스를 의미합니다.
- "이용자"란 이 약관에 동의하고 회사의 서비스를 이용하는 개인 또는 법인을 의미합니다.
- "게시물"이란 이용자가 서비스를 이용하면서 게시한 문자, 문서, 그림, 영상, 링크 등의 정보나 자료를 의미합니다.
제3조 (약관의 효력 및 변경)
- 이 약관은 서비스 화면에 게시하거나 기타 방법으로 이용자에게 공지함으로써 효력이 발생합니다.
- 회사는 합리적인 사유가 발생한 경우 관련 법령에 위배되지 않는 범위 내에서 이 약관을 변경할 수 있습니다.
- 약관이 변경되는 경우 회사는 변경 사항을 시행일 7일 전부터 서비스 내 공지사항을 통해 공지합니다. 다만, 이용자에게 불리한 약관의 변경인 경우에는 30일 이상의 기간을 두고 공지합니다.
- 이용자는 변경된 약관에 동의하지 않을 경우 서비스 이용을 중단할 수 있으며, 변경된 약관의 효력 발생일 이후에도 서비스를 계속 이용하는 경우 변경된 약관에 동의한 것으로 간주합니다.
제4조 (서비스의 제공)
- 회사는 다음과 같은 서비스를 제공합니다.
- SI(시스템 통합) 구축 관련 정보 제공 및 문의 접수
- SM(시스템 관리) 운영·유지보수 관련 정보 제공 및 문의 접수
- AI 컨설팅, 데이터 거버넌스, 클라우드·현대화 관련 정보 제공 및 문의 접수
- TG Alliance 파트너 네트워크 정보 제공
- 기타 회사가 추가 개발하거나 제휴를 통해 이용자에게 제공하는 일체의 서비스
- 회사는 서비스의 품질 향상 또는 기술적 필요에 의해 서비스의 내용을 변경할 수 있으며, 이 경우 변경된 서비스의 내용 및 제공일자를 명시하여 공지합니다.
- 서비스는 연중무휴, 1일 24시간 제공을 원칙으로 합니다. 다만, 시스템 정기점검, 증설 및 교체, 설비 장애 등으로 인해 서비스 이용이 일시적으로 중단될 수 있습니다.
제5조 (서비스 이용계약)
- 서비스 이용계약은 이용자가 이 약관의 내용에 동의하고 서비스를 이용하는 시점에 성립합니다.
- 회사는 다음 각 호의 이용 신청에 대해서는 승낙을 거부하거나 사후에 이용계약을 해지할 수 있습니다.
- 이 약관에 위반되는 내용으로 서비스를 이용하는 경우
- 허위 정보를 제공하거나 회사가 요구하는 정보를 제공하지 않는 경우
- 기술적으로 서비스 운영에 지장을 주는 경우
- 관련 법령에 위반되는 경우
제6조 (이용자의 의무)
- 이용자는 서비스를 이용함에 있어 다음 각 호의 행위를 하여서는 안 됩니다.
- 신청 또는 변경 시 허위 내용 등록
- 타인의 정보 도용
- 회사가 게시한 정보의 변경
- 회사 또는 제3자의 저작권 등 지식재산권에 대한 침해
- 회사 또는 제3자의 명예를 손상시키거나 업무를 방해하는 행위
- 외설 또는 폭력적인 메시지 등 공서양속에 반하는 정보를 게시하는 행위
- 기타 불법적이거나 부당한 행위
- 이용자는 관계 법령, 이 약관의 규정, 이용안내 및 서비스와 관련하여 공지한 주의사항을 준수하여야 합니다.
제7조 (회사의 의무)
- 회사는 관련 법령과 이 약관이 금지하거나 공서양속에 반하는 행위를 하지 않으며 지속적이고 안정적으로 서비스를 제공하기 위해 노력합니다.
- 회사는 이용자가 안전하게 서비스를 이용할 수 있도록 개인정보 보호를 위한 보안 시스템을 갖추고 개인정보처리방침을 공시하고 준수합니다.
- 회사는 서비스 이용과 관련하여 이용자로부터 제기된 정당한 의견이나 불만을 처리하고 그 결과를 이용자에게 통지합니다.
제8조 (서비스 이용의 제한)
- 회사는 이용자가 이 약관의 의무를 위반하거나 서비스의 정상적인 운영을 방해한 경우, 경고·일시정지·영구이용정지 등으로 서비스 이용을 단계적으로 제한할 수 있습니다.
- 회사는 관련 법령에 위반되는 행위를 한 경우에는 즉시 영구 이용정지를 할 수 있습니다.
제9조 (지식재산권)
- 회사가 제공하는 서비스 내 모든 콘텐츠에 대한 저작권 및 기타 지식재산권은 회사에 귀속됩니다.
- 이용자는 서비스를 이용하여 얻은 정보를 회사의 사전 승낙 없이 복제, 송신, 출판, 배포 등의 방법으로 영리 목적으로 이용하거나 제3자에게 이용하게 하여서는 안 됩니다.
제10조 (손해배상 및 면책)
- 회사는 무료로 제공되는 서비스와 관련하여 회사의 고의 또는 중대한 과실이 없는 한 손해배상 책임을 지지 않습니다.
- 회사는 천재지변, 전쟁 등 불가항력적인 사유로 인하여 서비스를 제공할 수 없는 경우에는 책임이 면제됩니다.
- 회사는 이용자의 귀책 사유로 인한 서비스 이용 장애에 대해 책임을 지지 않습니다.
- 회사는 이용자가 서비스에 게재한 정보, 자료, 사실의 신뢰도, 정확성 등에 관해서는 책임을 지지 않습니다.
제11조 (분쟁 해결)
- 회사와 이용자 간에 발생한 분쟁에 대해서는 대한민국 법률을 적용합니다.
- 서비스 이용으로 발생한 분쟁에 대해 소송이 제기될 경우 회사의 본사 소재지를 관할하는 법원을 전속 관할법원으로 합니다.
- 회사는 이용자가 제기하는 정당한 의견이나 불만을 반영하고 피해를 보상처리하기 위하여 최선을 다합니다.
제12조 (기타)
- 이 약관에 명시되지 않은 사항은 관계 법령 및 회사가 정한 서비스 운영 정책에 따릅니다.

Article 1 — Purpose
These Terms of Service ("Terms") govern the use of the website and all services ("Services") operated by TG SoftMine Co., Ltd. ("Company"), including conditions and procedures for use, rights and obligations of both the Company and users, and other necessary matters.
Article 2 — Definitions
- "Services" means the information, consultation, and inquiry services related to SI, SM, AI consulting, data governance, and Digital Transformation (DX) provided through the Company's website.
- "User" means any individual or legal entity who agrees to these Terms and uses the Services.
- "Post" means any text, documents, images, videos, or other materials submitted by a User while using the Services.
Article 3 — Effect and Amendment of Terms
- These Terms become effective when posted on the service screen or otherwise notified to Users.
- The Company may amend these Terms within the scope permitted by applicable laws when there is a reasonable cause.
- Amendments will be announced at least 7 days prior to the effective date (30 days for changes unfavorable to Users).
- Continued use of the Services after the effective date of the amended Terms shall be deemed acceptance of the changes.
Article 4 — Services Provided
- The Company provides: SI implementation information and inquiry services; SM operation and maintenance information; AI consulting, data governance, cloud and modernization information; TG Alliance partner network information; and any other services developed or provided through partnerships.
- The Company may modify the content of Services for quality improvement or technical reasons, with advance notice.
- Services are provided 24/7 in principle, but may be temporarily suspended for maintenance or technical reasons.
Article 5 — Service Agreement
- A service agreement is established when a User agrees to these Terms and begins using the Services.
- The Company may refuse or terminate a service agreement in cases of violations of these Terms, provision of false information, technical interference, or violations of applicable law.
Article 6 — User Obligations
- Users shall not: register false information; misappropriate others' information; infringe on intellectual property rights; defame the Company or third parties; post obscene or violent content; or engage in any other illegal or improper conduct.
- Users must comply with applicable laws, these Terms, and all usage guidelines and notices related to the Services.
Article 7 — Company Obligations
- The Company shall endeavor to provide Services consistently and stably in compliance with applicable laws.
- The Company shall implement security systems to protect personal information and shall publish and comply with its Privacy Policy.
- The Company shall address legitimate User complaints and notify Users of outcomes.
Article 8 — Restriction of Use
- If a User violates these Terms or disrupts normal service operations, the Company may progressively restrict use through warnings, temporary suspension, or permanent suspension.
- The Company may immediately impose permanent suspension for violations of applicable laws.
Article 9 — Intellectual Property
- All copyrights and intellectual property rights in the Services are owned by the Company.
- Users shall not use or permit third parties to use any information obtained through the Services for commercial purposes without prior written consent from the Company.
Article 10 — Liability and Disclaimer
- The Company shall not be liable for damages regarding freely provided Services unless caused by intentional misconduct or gross negligence.
- The Company is exempt from liability for service failures due to force majeure events.
- The Company is not responsible for disruptions caused by Users' own actions or for the accuracy of User-posted content.
Article 11 — Dispute Resolution
- Disputes shall be governed by the laws of the Republic of Korea.
- The court with jurisdiction over the Company's headquarters shall serve as the exclusive jurisdiction for litigation.
- The Company shall make every effort to address legitimate User complaints and provide appropriate remedies.
Article 12 — Miscellaneous
- Matters not specified in these Terms shall be governed by applicable laws and the Company's service operation policies.
